Premier Membership Terms and Conditions

Premier Plan General Terms

  • An event or session is defined as but not limited to any of the following types of professional photography occasions: Wedding, Engagement, Glamour/Boudoir, Family, HS Seniors, Baby, Maternity, Corporate/Non-Profit, Sporting, or Mitzvahs. Multi-day events such as traditional Indian weddings qualify as a single event and will be limited to the Premier terms below.
  • Premier plans are intended to cover professional photographers submitting professional events. Plans do not cover hobbies, personal projects, vacation photos, friends and family, etc.
  • Submitted orders may only contain a single event*.
    • Splitting a single event up into multiple orders is considered abuse and is grounds for cancellation, rejection, or a la carte billing of the orders.
  • Submitted events must be photographed explicitly by the subscriber to the plan. This is not a studio plan for multiple photographers working for a studio. The subscriber and a secondary photographer will be allowed for Weddings where both photographers are covering the same event.
    • Submitting events photographed by associates, other photographers, part-time staff, other studios or anyone not listed on the plan is considered abuse and is grounds for cancellation, rejection, or a la carte billing of the order.
  • Premier discounts cannot be combined with any other offers, specials, promotions, or discounts. They would be used in place of the Premier discount instead.
  • Premier discounts cannot be added to orders currently in progress and will only be applied to future orders after the Premier plan has been activated.
  • Premier plans start at a minimum 12 month consecutive commitment, payable in monthly installments.
  • Promotions giving free bonus months are applied after your 12 month contract unless explicitly specified.
  • Premier payments are non-refundable.
  • Premier plans can be terminated in one of two ways:
    • If for any reason you decide to cancel within the first 30 days of your contract; the Premier plan can be terminated by paying for any orders submitted since sign-up at current a’ la carte pricing. Any billed orders from this timeframe would be charged the difference.
    • If for any reason you decide to cancel after the first 30 days of your contract; because staffing is based on contracts, the Premier plan can be terminated by paying 50% of the remaining balance of your contract. In addition, once you terminate your contract, you will not be able to rejoin any Premier plan under any circumstances.
  • If payments are not fulfilled in full or if the contract is terminated for violating terms, you will be responsible for the entire amount of your contract and all collection costs associated with fulfilling your contract.
    • You agree to reimburse us the fees of any collection agency, which may be based on a percentage at a maximum of 50% of the debt, and all costs, and expenses, including reasonable attorney’s fees, we incur in such collections efforts.
  • Shipping and handling charges are not covered by this plan.

Premier Plan General Terms – Plan Compliance

  • Evolve reserves the right to adjust the Premier Plan terms and conditions at anytime.
  • Evolve reserves the right to reject any job that does not meet the plan terms and conditions listed above.
  • You agree that upon request from Evolve you will within 7 business days document and certify that the use of the plan is within the terms and conditions listed out here.

Premier Plan General Terms – Indemnification

  • You agree to hold Evolve and all of its employees harmless from any and all liabilities, losses, actions, damages, or claims including all expenses, costs, and attorney fees that should arise from any use of the Premier Plan.

Premier PRO Plan Terms and Conditions

  • The terms listed below are in addition to the Premier Plan General Terms listed above.
  • The Premier PRO Plan allows for up to 800 images for color correction per event. Any number of images submitted over 800 per event will be charged $0.15 per image.
  • In addition, this plan allows for up to 80,000 images for Image Selection/Culling and unlimited events for PS Batching services: JPG & Proof Upload during the 12-month term. Any images submitted beyond these limits are billed at add-on service cost listed below. No additional billing for PS Batching services: JPG & Proof Upload.
  • 2 Free Hybrid Edits per plan 12-month term – $200 value
  • 2 Free 2 day rush jobs per plan 12-month term
  • 3-5 business days turn time
  • 20% off all add-on services – including, Blog edits, Noir edits, Premium edits, Hybrid edits, Retouching, Album design and Album add-on services.
  • Special VIP offers for Premier Members ONLY

Premier ELITE Plan Terms and Conditions

  • The terms listed below are in addition to the Premier Plan General Terms listed above.
  • The Premier ELITE Plan allows for up to 800 images for color correction per event. Any number of images submitted over 800 per event will be charged $0.15 per image.
  • In addition, this plan allows for up to 80,000 images for Image Selection/Culling, up to 1,000 images for Premium edits, up to 50 images for Hybrid edits and unlimited events for PS Batching services: JPG & Proof Upload during the 12-month term. Any images submitted beyond these limits are billed at add-on service cost listed below. No additional billing for PS Batching services: JPG & Proof Upload.
  • 4 Free 2 day rush jobs per plan 12-month term
  • 3-5 business days turn time
  • 20% off all add-on services – including Blog edits, Noir edits, Retouching, Album design and Album add-on services.
  • Special VIP offers for Premier Members ONLY

Unlimited Albums

  • Unlimited Albums is an add-on plan that requires a Premier plan. The terms listed below are in addition to the Premier Plan General Terms listed above.
  • As a Premier Member, adding Unlimited Album design to your account will extend your contract date 12 months starting on the date of your next scheduled monthly Premier payment. Your first Unlimited Album payment will be prorated based on your sign-up date.
  • Unlimited Albums covers the first 20 spreads, per event, for an unlimited number of events. Any number of spreads submitted over 20 per event will be discounted 50% off a la carte pricing.
  • This plan covers spreads for Standard and Pre-design album types as well as Showcase and Heirloom album design styles.

Unlimited Albums – Revisions, Proofs and Design Expirations

  • Standard albums are allotted two rounds of revisions after the first proof of the album has been posted up to Album Exposure.
  • The initial proofs for an album should be expected to be available to view on Album Exposure within 3-5 business days. 
  • After comments are provided via direct email or through Album Exposure; Evolve will reach out to confirm the client is ready to proceed with the revisions for the next proof. 
  • After the second round of revisions has been posted to Album Exposure; Evolve will reach out to confirm if the client is ready to close the album or if they wish to add additional rounds of proofing to the order. 
  • Design Expiration: Standard albums have a 90 day shelf life. If an album exceeds the 90 day term without a request to extend the term, it will automatically be closed and delivered as-is via layered .psd files of the spreads. Automated reminders are sent 14 and 7 days out from the expiration date. The expired album in Album Exposure will be archived. Clients can opt to have the Fundy file (.fsd) delivered in place or in addition to the layered .psd files for an additional cost ($60 a la cart).
  • Pre-Design albums do not provide proofs and will not be uploaded for review to Album Exposure. These albums will have a standard delivery time of 3-5 business days. We will deliver both the .jpg files of the spreads as well as the layered .psd files to allow the client the option to alter the album design themselves.  

Unlimited Albums – Reentry, Extensions and Upgrading:

  • Standard albums will require a reentry fee ($50 a la cart) for the following scenarios:
    • The client wishes to extend the expiration date another 90 days.
    • After expiring an album from our system, the client wishes to re-enter the album in our system for additional changes.
    • The client wishes to upgrade a Pre-design album to a Standard album to take advantage of Album Exposure proofing after the Pre-design album has been delivered. This upgrade must take place within 30 days from delivery of the Pre-design album.
